The drama began when Turner, 27, filed a lawsuit in the Southern District of New York on Thursday, demanding the return of her two children, Willa, 3, and their 14-month-old daughter, identified as D. in court documents, to their “habitual residence” of England. Turner alleges the children were wrongfully retained starting “on or about September 20, 2023.”

According to the documents, Turner and Jonas had agreed that England would be their “forever home” after selling their Miami house in April. While Turner filmed the miniseries “Joan” in England, their daughters traveled with Jonas on tour.

A Clash of Legal Statements

Jonas, who filed for divorce from Turner on Sept. 5, responded with a statement expressing his belief in an amicable co-parenting arrangement during their recent meeting in N.Y.C. However, Turner alleges that Jonas is withholding their daughters’ passports, preventing her from returning to the U.K. with them.

Legal Experts Weigh In

To untangle this web of conflicting claims, we turned to legal experts Marilyn Chinitz and David Glass, neither of whom are involved in the Turner-Jonas legal battle.

Chinitz emphasized the importance of establishing the children’s “home state.” The couple’s nomadic lifestyle adds complexity to this task, as it’s not merely about where they spent the majority of their time but where they established roots.

Glass highlighted that living in a new international jurisdiction for six months is usually required for it to be considered the children’s habitual residence. However, Jonas claimed they were living in Miami, while Turner asserted they relocated to a London short-term rental in April.

Turner’s Strong Case for England

Turner makes a compelling case for England being their children’s legal home, citing their eldest’s “full time” nursery attendance and local doctors. She even claims they entered into a contract to purchase property in the U.K. in July, with the intent to raise their children there.

However, Chinitz warns that merely having a contract to purchase may not be enough legally. Brokers who showed them homes may need to testify to prove their shared intent.

Miami Home Sale Adds Complexity

The recent sale of their Miami home further complicates matters. Chinitz highlights the importance of identifying where the kids had their roots established, including doctors and activities.

No Easy Resolution

Both legal experts agree that there’s no straightforward solution, given the parents’ demanding careers and travel schedules. They suggest a private agreement via mediation or a private judge as the best path forward for the couple to resolve their differences.

As of now, a hearing date for the federal case regarding the children’s residence remains pending. This custody battle promises to be a thorny and uncertain one, with the children’s best interests hanging in the balance.
